CEO FSSAI is appellate authority under Advertising & Claims Regulations

The Food Safety and Standards Authority of India (FSSAI) has issued an order approving the appeal mechanism for the ‘Claims Approval Procedure’ under the Advertising and Claims Regulations and appointed the Chief Executive Officer (FSSAI) as the Appellate Authority.

Food businesses, whose applications for claim approval were rejected, can appeal to the CEO FSSAI against the rejection.

The order reads, “The competent Authority has approved that in regards to claims approval application and its review process, CEO FSSAI shall be the Appellate Authority.”

The order also says that the Chairperson FSSAI shall be the ‘Reviewing Authority’ under the claim approval procedure under the Advertising and Claims Regulations 2018.

The order added, “In case of rejection of claims of approval application, the food businesses may appeal to the Appellate Authority within 30 days of issue of rejection letter.”

Further, the FBOs can reach out to the Chairperson FSSAI through a review petition within 30 days of rejection by the Appellate Authority and in such an event the Chairperson’s decision shall be final.

In September 2019, the FSSAI issued a notice, defining the procedure for approval of claims on food products along with application fee.

For this purpose, the FSSAI had constituted an Expert Committee on Claims for the purpose of scrutiny and assessment of health claims, specifically disease risk reduction claims and other such claims made in advertisements.

The FBOs can apply for approval through an application form along with a fee of Rs 50,000 in form of demand draft for a maximum of 3 claim statements for a product or ingredient in a product.
