FSSAI withdraws order banning using differentiation in milk based on A1 and A2

The FSSAI has saved itself from landing in soup as it has withdrawn its controversial order of banning the food businesses involved in milk and milk products' trade, from using differentiation based on A1 and A2 categorisation.
The food regulator had earlier termed the differentiation as 'misleading'.
The withdrawal notice reads, "This is to inform that the advisory dt 21.08.2024 issued with respect to the subject cited (Clarification regarding Selling / Marketing of Milk & Milk products such as Ghee, Milk etc. in the name of A1 & A2), stands withdrawn for further consultation and engagement with the stakeholders."
Experts say that it appears that the food regulator took the decision under pressure from certain vested interests and without consultations with the stakeholders, as in its previous notice the FSSAI itself opined that A1 and A2 differentiation of milk is essentially linked to difference in structure of protein (beta casein).
The ban was essentially based on the ground that it was not in conformance with the provisions laid down under FSS Act, 2006, and that Food Safety and Standards (Food Product Standards and Food Additives) Regulations, 2011, does not mention the same.
However, neither it says such categorisation cannot be made.
The FBOs were earlier 'instructed' to remove such claims from their products and e-commerce FBOs were also instructed to remove all the claims related to A1 & A2 proteins from their websites 'immediately'.
And, the concerned FBOs were also asked to ensure strict compliance of the same with effect from the date of issuance of the direction.
But, now, the order stands withdrawn.
