HC Madurai Bench stays order on suspension of licence of KFC unit in Thoothukudi

The Madurai Bench of the Madras High Court has stayed an order by the Tamil Nadu state Food Safety Department, of suspending the licence of a KFC unit in Thoothukudi.
The High Court has observed that the state Food Safety Department took action without serving improvement notice to the concerned FBO.
KFC Thoothukudi unit was stripped off the FSSAI Licence after a surprise check by Food Safety officials found use of magnesium silicate-synthetic for purifying used oil.
The FSOs confiscated 18 kg of the chemical from the premises along with 45 litre of used oil, after the surprise check.
"The order (by the State Food Safety Department) is liable to be faulted on several grounds. Section 32(1) of the
Food Safety and Standards Act, 2006, provides for issuance of improvement notices. If the food business operator fails to comply with the improvement notice, his licence can be suspended. In this case, the licence has been suspended straightaway in the first instance," the court observed.
